NETTURUL SUPERKS TERMS OF SERVICE
Effective Date: 1st March 2021 The following conditions apply to the use of the NETTURUL SUPERKS service.
1. Acceptance of Terms
In these terms, we describe how Fasspay Payment Solutions Sdn Bhd. Registration No : 20120132773 (1017261-P) collect , use , process and disclose your personal data through the use of Netturul’s products and services provided to Netturul Resources Sdn Bhd (903910 D) for its application named Netturul including without limitation to our loyalty programme named “ Netturul Superks” services. By using the services , you agree to comply with and be legally bound by the terms and conditions of these Terms of Use (Terms), whether or not you become a registered user of the services. These terms govern your access to and use of the services and constitute a binding legal agreement between you and Netturul. Please read these terms and conditions carefully and Privacy Policy , which may be found at www.netturul.com, and which is incorporated by reference into these terms. If you do not agree to these terms, please do not use the services.
If you are under 18, you may only use the site with the supervision of your parent / guardian and we assume that all transactions are done with the consent of your parent and guardian.
2. Application
These terms apply to the services provided by us. No amendment, alteration, waiver or cancellation of any of these terms is binding on us unless confirmed by us in writing. You acknowledge that no employee or agent of us has any right to make any representation, warranty or promise in relation to these services other than as contained in these terms.
3. Rights of Access
3.1 Access to the mobile services is for personal use and access with limited rights, and
we reserve the right to withdraw or amend the service we provide on the Nettuurl superks services without notice. We will not be liable if, for any reason, any of the services are unavailable at any time or for any period.
3.2 From time to time, we may restrict access to some parts of the Netturul Superks services, or all sites, to users who have registered with us.
3.3 You are responsible and to safe guard your user identification code and password .
You must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.
3.4 You are responsible for making all arrangements necessary for you to have access to the Netturul superks services. You are also responsible for ensuring that all persons who access the services through your internet connection are aware of these terms, and that they comply with them.
4. Intellectual Property
We are the owner and the licensee of all the intellectual property rights in the Netturul superks services and all the contents and materials published on it. They are protected by Malaysia and International Copy Rights Laws. All such rights are reserved.
4.1 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
4.2 You must not use any part of the materials on the services for commercial purposes without obtaining a license to do so from us or our licensors.
4.3 If you print off, copy or download any part of the services in breach of these terms of use, your right to use the services will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
5. Content
5.1 Information Accuracy
Netturul Superks makes no representation or warranty as to the accuracy or fitness for use of any offers. Including , but not limited to , coupons posted vis the services or that any third party will honour or acknowledge any such coupons posted via the services. Netturul Superks is not responsible for providing any value for any coupons posted vis the services, Netturul Superks is not responsible for the change of information at third party sites, Merchant offer or stores including but not limited to coupon information, pricing ,availability or fitness for use. You understand that Netturul Superks does not and cannot review all material made available through websites linked or linking to any part of the services.Netturul Superks does not warrant that the services or any functions contained in Netturul Superks content available via the services will be uninterrupted or error free, that defects will be corrected, or that the services or the server that makes them available are free of viruses and bugs.
IN NO EVENT SHALL NETTURUL OR ITS AFFILIATES BE LIABLE FOR ANY DAMAGES ( WHETHER CONSEQUENTIAL , DIRECT, INCIDENTAL , INDIRECT, PUNITIVE, SPECIAL OR OTHERWISE ).
6. Disclaimer.
6.1. We provide Superks Services “as is”, “with all faults” and “as available.” We make no express promises or guarantees about the Services . To the maximum extent permitted by law, we and our employees, agents, suppliers, and merchants disclaim any implied contractual promises that the website and services are of satisfactory quality, accurate, timely, fit for a particular purpose or need, or non-infringing. We do not promise or guarantee that we will meet your requirements, is error-free, be without interruption or available at all times. We do not promise or guarantee that the results that may be obtained from the use of Netturul Superksl, including any services or deals, will be effective, reliable, accurate or meet your requirements. We make no promises as to privacy and security other than as expressly stated in our privacy policy. We do not promise or guarantee that you will be able to access or use the site or services at times or locations of your choosing. No oral or written information or advice given by a Netturul representative shall create any contractual promise. You may have additional consumer rights under your local laws that this contract cannot change.
6.2. 10 days Cooling Off Period for Sales and Membership Contract. The sales and membership contract are subjected to a 10 days cooling off period. With the said Netturul Superks online transactions / registrations, you have agreed to waive the terms and conditions for the said contract. The company will not be held liable for any circumstances
6.3. Release
You are solely responsible for your interaction with merchants and others user of the site. The extend permitted under applicable laws, you hereby release Netturul Superks from any/all claims & liability related to any product or service of a merchant, any action or inaction by merchant, including merchant’s failure to comply with applicable law, and any conduct or speech , whether online of offline , of any other user.
6.4. Limitation of Liability
6.4.1 The material displayed on the Netturul Superks is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:
6.4.2 all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
6.4.3 any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the Netturul Superks service or in connection with the use, inability to use, or results of the use of the Netturul Superks service, any linked to it and any materials posted on it, including, without limitation any liability for:
loss of income or revenue;
loss of business;
loss of profits or contracts;
loss of anticipated savings;
loss of data;
loss of goodwill;
wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
6.4.4 This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
7. Indemnities.
You acknowledge and agree to indemnify and hold Netturul Superks, its affiliates , officers, employees and agents, harmless , including costs and lawyers’ fees for any claims or demand made by any third party due to or arising out of your use of the services, your violations of these
terms , the infringement by you or made under your account (s) , of any intellectual property or other right of any person or entity or arising out of or related to any products or services purchased by you in connection with the services.
8. Assignment
You may not assign your rights and obligations under this agreement, in whole or in part, without prior written consent, and any such assignment without such consent will be null and void.
9. Termination of Service
Netturul Superks disclaims all responsibility and liability for the availability, timeliness , security or reliability of the services, Netturul Superks reserves the right to modify, suspend, or discontinue the services or access to the services without notice at any time and without any liability to you.
10. Waives / Severability
Any failure to enforce any provision of this agreement on the part of Netturul Superks will not be deemed a waiver of that provisions. Any waiver of any provision of this agreement by Netturul Superks on one occasion will not be deemed a waiver of any other provision or of such provision on any other occasion. If any provision of this agreement is held to be invalid, such invalidity shall not affect the remaining provision.
11. Applicable Law
By use of Netturul Superks Service, you agree to the above Terms and Conditions of use are governed by the Laws of Malaysia. Any disputes arise from the use of the website shall be arbitrated by the court in Malaysia jurisdiction.
12. Amendments of Terms and Conditions of Use
We reserve the right to amend the Terms and Conditions set forth herewith without prior notice.
